D088 and D394: recent rumors from the Ministry of Finance

From recent rumors, the Ministry of Finance is reportedly planning to make significant simplifications with regard to the 088 and 394 declaration forms.

In particular, Form 088, which since its introduction in February 2015 has considerably stiffened the procedure for the activation of a VAT Registration Number in Romania, may no longer be required from companies that change their Administrative Body, Corporate structure or registered office. As of today, as is well known, any change in the above-mentioned aspects results in the automatic request by the ANAF (National Agency of Financial Administration) to file documentation proving the company’s ability to carry out its characteristic activity (in fact to file the 088).

Regarding the new 394 declaration, which is particularly complex and the subject of another briefing, the current regulatory framework mandatorily requires its use from April 2016. The Ministry in an effort to simplify its use would plan to postpone its adoption from July 1, 2016.
